Terms of Use

These terms govern your use of this website. They do not govern any engineering services we may perform for you: those are governed by a separate written agreement signed by both parties. If you do not accept these terms, please do not use the site.

1.Who operates this site

This website is operated by Electrical Engineering FCP Panamericanes, S.A.S. de C.V., trading as PanAmerican Engineering Solutions, taxpayer registration (RFC) EEF250809B99, with registered address at Calle Tauro 4250, Colonia Juan Manuel Vallarta, Zapopan, Jalisco, 45120, Mexico. Contact: contacto@panamericanes.com. In these terms, “we”, “us” and “our” refer to that entity, and “you” refers to the person or company using the site.

2.What this site is, and what it is not

This site describes our estimating, pre-construction and project management services and lets you contact us. That is its whole purpose.

  • Nothing here is an offer. The descriptions, capabilities and processes on this site are an invitation to discuss work. A binding commitment on our side exists only in a written quote or agreement signed by an authorised representative.
  • Nothing here is engineering advice. Reading this site, or sending us a request through it, does not create an engineer-client, consultant-client or any other professional relationship, and you should not rely on anything published here in designing, pricing or building a project.
  • No prices are published. Any figure mentioned on this site that describes market conditions or third-party costs is context taken from published industry sources, not a price we offer or a saving we commit to.

3.Estimates and deliverables

When we are engaged, we produce quantity takeoffs, estimates, budget documents and related deliverables. Those documents are professional work product prepared from the drawings, specifications and assumptions available at the time. They are estimates, not guarantees: we do not warrant that a bid prepared with them will be won, that actual construction cost will match them, or that they substitute for the review and professional judgement of the licensed professional of record on your project. Responsibility for the bid you submit, and for the design you build, remains yours.

The scope, deliverables, delivery dates, revision rights, warranties and remedies applicable to any engagement are set out in the written agreement for that engagement, which prevails over anything on this site.

How to read the service commitments on this site. Where we describe how we normally work — for example that we reply to enquiries within one business day, that a supervisor reviews every package before it is delivered, that three rounds of revision are included, that we work Monday to Friday from 8 to 5, or the number of projects we can run at once — we are describing our standard practice at the date shown above, in good faith. Those statements are not warranties, service levels or contractual commitments, and they do not create one. The response times, revision rights and service levels that actually bind us are only the ones written into the signed agreement for your engagement.

4.Do not send confidential documents through this site

This is important. The quote form on this site — the same form on the home page and on the Contact page — is for a short description of your project. It has no file upload and it is not a secure channel for confidential material.

Do not send drawings, specifications, pricing, bid documents or any other confidential information through this website or by unsolicited email. We will exchange confidential material only after a non-disclosure agreement is in place, using the channel agreed with you. Anything you send us before that is received on a non-confidential basis, and we accept no obligation of confidentiality or non-use with respect to it.

5.Acceptable use

You agree not to:

  • Use the form to send false or misleading information, or another person's contact details without their authorisation.
  • Submit unsolicited commercial messages, malware or any content that is unlawful or infringes anyone's rights.
  • Attempt to access parts of the site or its systems you are not authorised to access, probe or test its security, or interfere with its operation.
  • Scrape, harvest or systematically extract content for the purpose of reproducing it commercially, or use automated means to submit the form.

We may block access and pursue any remedy available to us if you do.

6.Our intellectual property

The text, layout, graphics, photographs, the PanAmerican Engineering Solutions name and logo, and the arrangement of this site are owned by us or licensed to us and are protected by copyright and trademark law. You may view and print pages for your own business evaluation. You may not copy, republish, or use our name, logo or content to promote another business, or in a way that suggests we endorse or are affiliated with it, without our prior written permission.

7.Third-party names and logos

This site refers to software and to companies we work with or whose products appear in the projects we estimate — among them ConEst IntelliBid, Bluebeam Revu, Procore, AutoCAD, Revit, PlanGrid, DIALux and Jira. Those names and logos are the trademarks of their respective owners and are used to identify the tools and the relationships described, in each case nominatively. Their appearance does not imply that any of those owners endorses, sponsors, certifies or is affiliated with us beyond what is expressly stated in the accompanying text, and we claim no rights in them.

8.Disclaimer

We keep this site accurate and available as best we reasonably can, but we provide it “as is” and “as available”. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the site will be uninterrupted, error-free, or free of harmful components. Nothing in this section limits any warranty we give in a signed services agreement.

9.Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business or lost data, arising out of your use of this website, even if we were advised such damages werepossible. Our aggregate liability arising out of your use of this website will not exceed one hundred US dollars (USD $100). Liability for our professional services is governed exclusively by the signed agreement for those services, not by this section.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of sections 8 and 9 may not apply to you. Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud or for wilful misconduct.

10.Links to other sites

Where this site links to a third-party site, we do not control that site and are not responsible for its content, its accuracy or its privacy practices. A link is not an endorsement.

11.Governing law and jurisdiction

These terms are governed by the federal laws of the United Mexican States and, where applicable, the laws of the State of Jalisco, without regard to conflict-of-law rules. Any dispute arising from these terms or from your use of this website will be submitted to the exclusive jurisdiction of the competent courts of Zapopan, Jalisco, Mexico, and both parties waive any other forum to which they may be entitled by reason of their present or future domicile.

This section governs the website only. The governing law and dispute resolution mechanism for a services engagement are set in the agreement for that engagement.

12.Changes, term and termination

We may modify these terms at any time by publishing a new version on this page with a new effective date. The version in force when you use the site is the one that applies to that use; continuing to use the site after a change means you accept the new version. We may also change, suspend or discontinue any part of the site, or restrict your access to it, at any time and without notice. Sections 4, 6, 7, 8, 9 and 11 survive any termination.

13.How you accept these terms

You accept these terms by submitting the quote form, which states so immediately above the send button, or by otherwise using the site after these terms are published. If you do not accept them, do not use the form and do not use the site.

If a provision of these terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.

14.Privacy

How we handle the personal data you send us is described in our Privacy Policy (Aviso de Privacidad, the governing Spanish version) and our Cookie Policy.
